On June 17, 2020, on the basis of accusations from the domestic industry, the DOC initiated an investigation to avoid trade remedies with Vietnam's hardwood plywood products to ensure the effectiveness of the measures. Trade remedies are being applied to China's hardwood plywood.

On July 25, 2022, the DOC announced the preliminary conclusion of the investigation of evasion of trade remedies against hardwood plywood imported from Vietnam.

The preliminary conclusion of the DOC is that, if plywood from Vietnam has a core using peeled boards imported from China, it will be subject to anti-dumping and anti-subsidy tax as applied to imported plywood. import from China.

Plywood from Vietnam, if it has a core using peeled boards manufactured in Vietnam or in other countries, is not subject to anti-dumping and anti-subsidy tax.

Based on this preliminary finding, the DOC will recommend that U.S. Customs and Border Protection (CBP) continue to suspend liquidity and require importers to pay a deposit equal to the provisional anti-circumvention tax rate for the company. with shipments imported from Vietnam into the United States from June 17, 2020 (the date of notification of initiation of investigation) for cases subject to the application of measures.

The DOC allows Vietnamese exporters as well as US importers participating in the self-certification mechanism to be excluded from circumvention. This self-certification mechanism will not apply to businesses that the DOC assesses as failing to provide information or providing incomplete and inaccurate information as requested by the DOC during the investigation process. According to calculations, the number of enterprises participating in self-certification accounted for about 80% of Vietnam's export turnover during the investigation period.

Stakeholders have the right to submit written comments on the DOC's preliminary findings, and a written request for a hearing on the comments must be filed with the DOC within 30 days of the notice. preliminary conclusion. The DOC also plans to conduct due diligence to verify the information before issuing a final conclusion.

The Vietnam Timber and Forest Products Association has coordinated with the Trade Remedies Department to send comments of the association and the Ministry of Industry and Trade on this preliminary conclusion to the DOC to support businesses and guide businesses to related industry regarding the DOC's subsequent investigative provisions.

Thus, until August 22, the DOC has not made a final decision that Vietnam's hardwood plywood products exported to the United States are subject to anti-dumping and anti-subsidy taxes.

Besides, according to the latest announcement, the DOC extended the time to issue the final conclusion in this case to October 17, 2022.

For wooden cabinets, specifically kitchen/bathroom cabinets, VIFOREST informed, on the basis of accusations from the domestic industry, on May 24, 2022, DOC initiated a product scope investigation (Scope). Ruling) and on June 7, 2022, DOC initiated an investigation to avoid trade remedy tax (Anti-circumvention) with wooden cabinets imported from Vietnam and Malaysia. Under the new US regulations, within 300 days of initiation, the DOC must issue a final conclusion of the case, which can be extended, but the total time cannot exceed 365 days.

HVIFOREST has coordinated with the Trade Remedies Department to submit comments from the association and the Ministry of Industry and Trade on the wooden cabinet case to the DOC to support businesses and guide related businesses to comply with regulations and procedures. investigation by the DOC.

According to VIFOREST, the submission of comments by interested businesses is voluntary, not required under the regulations of the DOC.

“On August 4, 2022, the DOC announced that it had rejected the comments of 40 units due to late submission but no decision on tax imposition and the case is still under investigation,” the statement emphasized.
